As reported in the Burlington County Times, the Lourdes Health System has operated a satellite emergency department (ED) at Deborah Heart and Lung Center since 2010, but Deborah is now seeking court intervention to end that partnership with Lourdes before it is acquired by Virtua. Deborah accused Lourdes of breach of contract while asking the New Jersey Superior Court to order Lourdes to vacate the satellite ER so Deborah can partner with a new, unnamed healthcare provider. Deborah alleges the deal between Lourdes and Virtua breaks a 2008 binding letter of intent (LOI) between Deborah and Lourdes, as well as a 2009 master partnering agreement between the two providers and a 2009 lease agreement. The complaint seeks to restrain Lourdes and Virtua from closing on the proposed merger, as well as to restrain Virtua from taking ownership or control of the satellite ED.
